IMAX’S CALL FOR SUBMISSIONS – Superman Fan Art

THESE SUBMISSION TERMS (“SUBMISSION TERMS”) ARE A CONTRACT, SO READ THEM CAREFULLY BEFORE MAKING A SUBMISSION. WITHOUT LIMITATION, THIS CONTRACT INCLUDES INDEMNITIES FROM YOU AND A LIMITATION OF YOUR RIGHTS AND REMEDIES.

Description: IMAX Corporation (“IMAX”) is soliciting submissions of fan art in connection with the motion picture “Superman” (the “Film”). Fan art must be submitted in accordance with the “Submission Requirements” set forth below.
Eligibility: This “Call for Submissions” is open to legal residents of one of the 50 United States or District of Columbia who are at least 18 years old at the time of submission.
Submission Period: The “Submission Period” begins at 9:00AM ET on June 16, 2025 and ends at 11:59AM ET on June 30, 2025. IMAX’s clock will be the official timekeeping device for submissions.
How to Enter: During the Submission Period, you may enter through the Superman: IMAX Fan Art website, located at www.imax.com/supermanfanart (the “Website”). The Website will contain an entry form and on-screen instructions to upload your fan art inspired by the Film. Upload your fan art and complete the entry form with your first and last name, e-mail address, and zip code and click on the "Submit" button (collectively, “Submission”). You must complete the entry form with all required information for the entry to be eligible. Only complete entries (with all the information requested) will be accepted as a valid submission. There is a limit of two (2) entries per email address. Entries will only be accepted during the Submission Period. No other methods of entry will be accepted. You must have accepted IMAX’s Terms of Use and Privacy Policy by checking the applicable box. By entering a Submission, you indicate your full agreement to these Submission Terms.
Submission Requirements: The Submission must meet the following content requirements (“Submission Requirements”):

All aspects of all Submissions must be originally created by and solely owned by the applicable entrant or in the public domain, except that you may include Film Content (as defined below) in the Submissions and may make certain incidental, non-infringing use of third-party materials as described below. “Film Content” means the name of the Film (including the Superman logo) and the DC characters depicted in the Film. Film Content is allowed solely for use as part of a Submission made in accordance with these Submission Terms and may only be used in a positive and non-disparaging manner. You understand that the Film Content is the property of Warner Bros. Entertainment Inc. (“WB”) and WB owns all right, title, and interest in and to any copyrights, trademarks, and all other intellectual property rights in the Film Content.
Submissions must not contain any content (including any text, photograph, image, or artwork) that is owned by any person or entity other than the entrant unless it: (i) is in the public domain; (ii) is among the Film Content; or (iii) is, as determined by IMAX and WB in their sole discretion, non-infringing use of third party content that is incidental, in the background, and/or not the focal point of any Submissions.
Submissions may include poetry (i.e. poetic text on your Submission) that is originally created and solely owned by you or in the public domain. Do not include any third party poetry in Submissions.
Submissions must not depict or include any third party other than those third parties depicted or contained in the Film Content.
Submissions must not create any association between the IMAX and/or WB and any individual or entity or his, her, or its products or services.
Submissions must not include, mention or depict the use of alcohol or tobacco products, illegal drugs, politics, or the taking up of arms against any person, government or entity (or otherwise challenge or seek to overthrow any government).
Submissions must not contain material which is (or promoting activities which are) sexually explicit, obscene, pornographic, violent, discriminatory (based on race, sex, religion, natural origin, physical disability, sexual orientation or age), illegal (e.g. underage drinking, substance abuse, computer hacking, etc.), offensive, threatening, profane, or harassing; or material that contains any derogatory references to IMAX or WB.
Submissions must not have been previously submitted to another contest, broadcast on a media or social network or submitted to any other entity.
Submissions must not include mention or performance of any copyrighted media production including but not limited to comic books, music, books, television or online programming, etc., or identifying descriptions of any media property except as set forth above.
Submission must not include materials that violate or infringe another person’s or third party’s rights, including, but not limited to, privacy, publicity or intellectual property rights. Submission must not include any third-party logos.
Submission must not contain any viruses, spyware, malware, or other malicious components that are designed to harm the functionality of a computer or network in any way.
Submission must be suitable for presentation in a public forum.
No AI-generated art.

General Conditions: If you submit a Submission which violates any of the Submission Requirements, the Submission may be void at IMAX’s sole discretion. IMAX reserves the right in its absolute discretion to reject any Submission which it deems to contain objectionable or offensive content. Obscene, provocative or otherwise questionable content will not be considered. IMAX retains sole discretion as to what constitutes inappropriate or fair content. Only those Submissions that fulfill the entry requirements and do not violate any of the content requirements shall be considered for use by IMAX (in a gallery available on the Website or otherwise). For clarity, IMAX is not required to feature any specific number of Submissions on the Website or in any other manner or media; IMAX in its sole discretion may elect to feature or otherwise use one or more Submissions or no Submissions at all.
Rights in Submissions: In consideration of a Submission being reviewed and evaluated by IMAX, you hereby grant to IMAX and WB and their respective affiliates all rights in and to the Submission, including, without limitation any copyright therein, and the exclusive, perpetual, royalty-free, irrevocable, fully paid, universal right and license to use, license, incorporate, broadcast, telecast, webcast, distribute, re-use, publish, re-publish, edit, composite, morph, scan, duplicate, alter or otherwise exploit such Submission (and to permit others to do the same), or any portion thereof, including to the extent applicable (a) any information, biographical data, and material (e.g., the “creative” file or Submission) submitted; and (b) all graphics, statements, quotations and any other creative materials furnished as part of the Submission (the “Materials”) in any media now known or hereafter devised, including, but not limited to, all forms of electronic media, print media and all forms of Internet and wireless protocol, and for any and all purposes including without limitation merchandising, advertising, marketing, promotion or for any other commercial or non-commercial purpose. Further, you acknowledge and understand that IMAX and WB shall have the right to make unlimited derivative works of the Submission and to assign or transfer any or all such rights in and to the Submission. You understand that your name and other Materials may be publicly displayed on a number of websites, including, without limitation, on the Website, and may be a part of IMAX’s marketing campaign for the Film. You agree that the Released Parties (as defined below) or any of their respective affiliates, have no obligation to use or otherwise exploit any Materials, including without limitation, any Submission. Without limitation to the language set forth in these Official Rules, you release the Released Parties, as defined below, from any and all claims or liability (now known or hereafter arising), including, but not limited to, any claims for defense and/or indemnity, in connection therewith. You agree and acknowledge that participation in this Call for Submissions shall not give rise to any confidential, fiduciary, implied-in-fact, implied-in-law, or other special relationship between the you and IMAX and/or WB, nor does it place you in a position that is any different from the position held be members of the general public with regards to elements of the Submission, and that the only contracts, express or implied, between the Released Parties and you are these Submission Terms.
DC: DC and its partners, affiliates, licensees, writers, and artists are constantly coming up with new adaptations and versions of DC’s characters and related elements. If in the future you see something in a DC comic book, on merchandise, or in any film, television, or other production that reminds you of something that you included in your Submission, please understand that such similarity, in all likelihood, is coincidental, and, in any case, DC and its affiliates are not agreeing to credit or pay you for the use of any element or ideas similar to those in your artwork Submission.
Release and Limitations of Liability: By participating in this Call for Submissions, you agree to release and hold harmless IMAX, WB, Regal Cinemas Inc., and each of their respective parent, affiliates, and subsidiaries, and each of their respective officers, directors, employees, and agents (the “Released Parties”) from liability of any kind or nature for any injuries, damages or losses of any kind or any other costs or expenses resulting from or arising from any breach or alleged breach of any of the warranties, representations or agreements made by you hereunder, or from your participation in this Call for Submissions.
Privacy and Publicity: Any information you submit as part of the Call for Submissions will be used for purposes of this promotion and treated in accordance with IMAX’s Privacy Policy. To “opt out” of the disclosure of any of your personal information by IMAX, e-mail IMAX at privacy@imax.com or write to IMAX at IMAX Corporation, 12582 West Millennium Drive, Los Angeles, CA 90094, providing your name, address, and indicating your request to opt-out. Except where prohibited, participation in this Call for Submissions constitutes your consent to IMAX’s use of your name, likeness, voice, opinions, biographical information, and jurisdiction of residence for promotional purposes in any media without notice or further consideration. WB is not a host, sponsor, or administrator of this Call for Submissions. By entering, you are providing information to IMAX and not WB.
Disputes: You agree that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Los Angeles, California. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of California, without giving effect to any choice of law or conflict of law rules (whether of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than California.
Warner Bros. Entertainment Inc., Regal Cinemas, Inc., and each of their parents, affiliates and subsidiaries are not responsible for the promotion, administration or execution of this Call for Submissions.
